Terms and conditions<\/strong><\/h2>\n\n\n\n

1. Scope of application<\/strong><\/p>\n\n\n\n

These Terms and Conditions establish the conditions for\naccess to and use of the website https:\/\/fica-oc.pt (hereinafter referred to as the \"site\")\nand any commercial transaction carried out through it, which the user and\ncustomer undertakes to comply with.<\/p>\n\n\n\n

Viewing or carrying out any commercial transaction\nthrough the site constitutes acceptance of these terms and\nconditions.<\/p>\n\n\n\n

Fica has the right to change at any time the\nthese Terms and Conditions without prior notice, the user and\ncustomer is responsible for consulting and reading them periodically,\nas the conditions in force will apply at all times.<\/p>\n\n\n\n

2. About us<\/strong><\/p>\n\n\n\n

The site https:\/\/fica-oc.pt (hereinafter referred to as the \"site\") is the property of Fica Oficina Criativa, Unipessoal Lda (hereinafter referred to as \"Fica\"), with VAT number 514096624, registered office at Rua de Arroios 154B, 1150-056 Lisboa, legitimate owner of the Fica trademark.<\/p>\n\n\n\n

3. Customer and user obligations<\/strong><\/p>\n\n\n\n

The user and client of the site must comply with and respect the\nthese terms and conditions and guarantees certain obligations for the proper\noperation of the website, such as:<\/p>\n\n\n\n

- Use this site only for legally valid inquiries and requests;
- Any defamatory, obscene, xenophobic and\/or other content that violates current legislation, general principles of law and public order is prohibited;
- Never make false or fraudulent requests;
- To grant the personal data strictly necessary for the processing of your orders and requests;
- Alert you to any changes that compromise the processing of your orders;
- Fica shall have no liability whatsoever in the event of incorrect or insufficient data being provided by the customer, which is necessary for the correct processing of orders;
- It is forbidden to send, introduce and\/or transmit, or allow the sending, introduction and\/or transmission, through Fica's website or social networks, of illegal or illicit content, computer viruses or any other technologically harmful or damaging software or material. You must not attempt to gain unauthorized access to this website, the server on which it is hosted, or any server, computer or database related to our website. The user undertakes not to attack this site via any denial-of-service attack or a distributed denial-of-service attack.
Any failure to comply with the provisions of this clause shall be considered an infringement under the terms defined by the applicable legislation. Fica will report any breach of this regulation to the corresponding authorities, and will cooperate with them to determine the identity of the attacker. Likewise, in the event of non-compliance with this clause, authorization to use this website will be immediately suspended.
Fica disclaims any liability for any damage or injury resulting from a denial-of-service attack, viruses or any other technologically harmful or damaging software or material that may affect the user's IT equipment, information or materials as a result of using this site, downloading content from it or from third-party sites to which the user is redirected by this site.<\/p>\n\n\n\n

4. Trade policy<\/strong><\/p>\n\n\n\n

The online store's product catalog may differ from the physical store's in terms of\nstore, both in terms of stock, price and products presented.<\/p>\n\n\n\n

Fica reserves the right to change the\nproduct catalog, including prices and specifications. Although Fica\nkeeps the information on the site up to date, whenever we process an order and\nan order and we find an incorrect price, Fica must refund the difference\nif the price is lower than indicated. 5. Our services<\/strong><\/p>\n\n\n\n

We provide training services in our workshop and on the website you can register and pay for the scheduled training sessions. On the training program page of the website, you will find all the necessary information regarding: Craft, topic, training content, useful information, duration, timetable, address and price.
Fica cannot be held responsible for incorrect information, including prices, on other websites that are not owned by Fica. Nor on social networks, even Fica's own.
The information should be checked on the Fica website where these terms and conditions can be found.<\/p>\n\n\n\n

The other services we provide may be listed on the\nwebsite but it is not possible to place orders through it.<\/p>\n\n\n\n

6. Our products<\/strong><\/p>\n\n\n\n

Our products are mostly handmade and are not\nmass-produced, so we cannot guarantee that they will be exactly as\nshown in the photographs. Some products are unique, one-off editions.\ncopy. They are handmade, exclusive and unique. We recommend that you consult the\ncharacteristics and details of the product you wish to purchase.\nmay vary or be merely illustrative.<\/p>\n\n\n\n

Product orders are subject to availability\nand all products have limited stock. Fica reserves the right to\ncancel an order if it is out of stock and undertakes to\nrefund the customer.<\/p>\n\n\n\n

7. Gift certificate<\/strong><\/p>\n\n\n

7.1 No date<\/p>\n

O gift certificate<\/a> is valid for all training courses and products in the online store. You can choose the amount between 10\u20ac (minimum) and 250\u20ac (maximum). Each gift voucher has a code that can be entered directly into the online store.
The gift certificate is digital and will be sent to the e-mail address indicated in the purchase process (sending may take up to 48 hours).
The instructions for use in the purchase process are indicated on the digital gift check. In the purchase process, you can indicate in the additional information the name of the person who will receive the check.<\/span><\/p>\n

It cannot be exchanged or sold. It is not convertible into cash or refundable, either in full or in part.
The total amount must be used in one go and cannot be used for more than one purchase.
It is not possible to purchase gift vouchers using the value of another gift voucher.
The check is valid for 12 months. After the expiry date, it will not be valid.<\/p>\n

Cancellation of reservations by the recipient or purchaser is only permitted 7 days before the start of the workshop. The recipient of the gift certificate will not be entitled to a refund of the amount of the gift certificate, only to reschedule the training. Exceptionally, there may be workshops with a longer notice period, if so indicated in the event\/registration.<\/p>\n

FICA has the right to cancel or postpone any training, even in the case of gift voucher registrations, when the minimum number of participants indicated has not been met and is responsible for rescheduling the training. In such cases, the recipient of the gift voucher will not be entitled to a refund of the amount of the gift voucher, but another date for the training will be rescheduled.<\/p>\n\n\n

7.2 With date<\/p>\n\n\n\n

In this case, you will have to purchase a\nand indicate in the additional information that you want a gift certificate.\nThis guarantees registration for the training indicated and on the date indicated and the\nrecipient does not need to pre-book their participation.<\/p>\n\n\n\n

7.3 Changes to formations<\/p>\n\n\n\n

Training courses, for which checks are valid, are subject to change. Both in terms of program content, duration, value and venue. Whenever there is a change in the value of the training (decrease in the value of the training in relation to the value of the gift voucher), FICA is responsible for making up the difference by creating a Gift Voucher with the missing value. The Gift Voucher can be used on any training or product for sale in the workshop or online store.

Fica may, at any time, change the syllabus of the training courses without justification.<\/p>\n\n\n\n

8. Online ordering<\/strong><\/p>\n\n\n\n

All our items are sold from the\nWordPress e-commerce platform.<\/p>\n\n\n\n

No registration is required to purchase\nan item.<\/p>\n\n\n\n

The validation of the order presupposes that the user and customer has\nand accepts the Terms and Conditions of this website.<\/p>\n\n\n\n

9. Confirmation or cancellation<\/strong><\/p>\n\n\n\n

9.1 Purchase of products<\/p>\n\n\n\n

Fica reserves the right to cancel any purchase\neven if it has already been accepted or confirmed by Fica, when:<\/p>\n\n\n\n

- There is an error in the presentation of the item's price;
- There is incorrect information, namely on the date, time and price, in a scheduled training course, which compromises the other training courses;
- When the customer does not provide a shipping address;
- When the order is indicated as irregular or susceptible to fraud by the site's security systems;
- If you assume that the order comes from a reseller;
- In the event of a stockout.
<\/p>\n\n\n\n

9.2 Cancellation of registrations<\/p>\n\n\n\n

Cancellation\/postponement\/refund of registrations (including gift voucher registrations) is only allowed if you give us at least 7 days' notice of the start of the training. Any cancellation with less than 7 days' notice, we will do our best to fill your place, however, the postponement (or putting the amount in a gift voucher) can only be carried out if your place is filled. Exceptionally, there may be trainings with a longer notice period, if so indicated in the event\/registration.<\/p>\n\n\n\n

FICA has the right to cancel or postpone any training that does not meet the minimum number of participants indicated and is responsible for rescheduling or refunding the registration fees paid (Fica is not responsible for refunding PayPal fees).<\/p>\n\n\n\n

In the event of any withdrawal during a training course, the trainee will not\nbe entitled to a refund of the registration fee paid.<\/p>\n\n\n\n

If a trainee fails to attend one or more\nsessions, FICA is not responsible for replacing or\nthat session.<\/p>\n\n\n\n

9.3 Gift cheque<\/p>\n\n\n\n

Cancellation of reservations by the recipient or purchaser is only permitted 7 days before the start of the workshop. The recipient of the gift voucher will not be entitled to a refund of the value of the gift voucher, only to reschedule the training, when done 7 days before the start of the workshop. Exceptionally, there may be training sessions with a longer notice period, if so indicated in the event\/registration.<\/p>\n\n\n\n

10. Prices and payment terms<\/strong><\/p>\n\n\n\n

In accordance with current legislation, all items available on this site are subject to\nthrough this site are subject to Value Added Tax (VAT).\nThe price is marked with VAT included at the legal rate in force, excluding\nshipping costs. <\/p>\n\n\n\n

The customer and user of this site has at their disposal\nthe following payment methods:<\/p>\n\n\n\n

- Bank transfer - Orders\/registrations must be paid for within 3 days, otherwise they may be canceled. If the deadline for a training session is less than 5 days, payment must be made within 24 hours, otherwise the registration will be canceled. We do not accept payments by bank transfer less than 2 days before the training takes place.
Proof of payment must be sent. Payment will only be valid once proof of payment has been sent and received. The order will be dispatched when payment is received;<\/p>\n\n\n\n

- Pay Pal - We apply a fee of 0.5% to this payment method (the amount invoiced by FICA does not include the fee);<\/p>\n\n\n\n

- Payment of Services at the Multibanco - with entity and reference, at any Multibanco ATM or through your homebanking service. (Only available to customers of Portuguese banks. Payment service provided by IfthenPay - certified website). Orders\/Registrations must be paid for within 3 days, otherwise they may be canceled. If the deadline for training is 3 days, payment must be made within 24 hours, otherwise the registration will be canceled;<\/p>\n\n\n\n

- MB WAY - Simple payment using \"MB WAY\" on your cell phone. (Only available to customers of Portuguese banks with the MB WAY app installed. Payment service provided by IfthenPay - certified website).<\/p>\n\n\n\n


Orders\/registrations must be paid for within 3 days, otherwise they may be canceled without prior notice. Payments after 3 days do not guarantee registration if there are no more vacancies. In such cases, the registration fee will be refunded.<\/p>\n\n\n\n

Fica has the right to change product prices and shipping costs at any time, but without affecting completed orders.
All courses and products are subject to price increases at any time without prior notice.<\/p>\n\n\n\n

11. Shipping costs and delivery time<\/strong><\/p>\n\n\n

Terms of sale
All orders are subject to availability and confirmation of the order price.
Shipping times may vary according to availability and are subject to any delays resulting from service delays or force majeure for which we will not be held responsible.<\/p>\n

Prices and Availability
It is in our interest to ensure that all prices, descriptions and details of a product are as clear and accurate as possible, however errors may occur. If we become aware of errors in the price of any merchandise, product or shipping charge, you will be informed of this and given the option to re-confirm the order at the correct price or cancel it. If we are unable to contact you, the order will be canceled. If payment has already been made, after canceling the order, we will give you a full refund.<\/p>\n

Shipping costs and delivery time
Order processing for all products in the online store can take between 48 and 96 hours after payment confirmation. After this time we will send an email with delivery instructions depending on the product purchased.<\/p>\n

Shipping costs are calculated individually based on the weight\/volume of the order and the shipping zone.<\/p>\n

Deliveries in the municipality of Lisbon:
Estimated delivery time is 1-3 working days after the order has been processed. Shipments are made by CTT Expresso, or other means.
In rare cases, delivery times may be delayed.
Any delay in the dispatch of items, in relation to the estimated delivery dates that may have been submitted, does not entitle the Customer to any compensation.<\/p>\n

We recommend that you indicate an address where you are sure there is someone to receive it, as our shipments are mostly registered and require the presence of a recipient. FICA cannot be held responsible for delivery failures due to absence. In the event of a delivery failure, it may be necessary to pay the postage again or collect it from a CTT office.<\/p>\n

When the order is confirmed, you will receive an email confirming payment. Orders will only be shipped once payment has been confirmed.<\/p>\n

Deliveries in mainland Portugal:
If the items are available in stock, delivery to mainland Portugal takes at least 1-3 working days after the order has been processed.
Any delay in the dispatch of items, in relation to the estimated delivery dates that may have been submitted, does not entitle the Customer to any compensation.
The maximum shipping limit is 30kg.<\/p>\n

Island deliveries (Azores and Madeira):
Once the order has been processed, delivery takes at least 4-8 working days.

Deliveries abroad:
Delivery times abroad may vary depending on the location. In these cases, the customs services of each country may charge additional fees. FICA is not responsible for these charges, please contact your country's customs service.<\/p>\n

The package couldn't be delivered because no one was at the address given:
If there is no one at the address given by the customer or if the wrong address is given, the order will be returned to FICA and the cost of returning the order will be charged to the customer who requested the service. The order will be sent back to the customer as soon as the costs have been settled.
If the order is returned due to an incorrect address, it will only be resent after confirmation of the new address and payment of the shipping costs.<\/p>\n

During periods when the workshop is closed (vacations, etc.), which are always indicated on the website, orders will only be processed and shipped after the day indicated.<\/p>\n

On-site survey:
After placing your order, you will receive an email with all the information you need to pick up your order.
On-site collection takes place from Tuesday to Thursday (2pm - 6pm) and Saturday (10am - 1pm \/ 2pm - 6pm). Contact us if you are not available during these times.

12. Returns and exchanges<\/strong><\/p>\n\n\n\n

The customer may cancel the order before it is dispatched and will be entitled to a refund of the sums paid.<\/p>\n\n\n\n

Fica does not accept exchanges but does accept returns. Most\nproducts are handmade, and may contain unique aspects and slight variations\ndue to their manual characteristics, these details cannot be\nconsidered defects. <\/p>\n\n\n\n

The Customer shall be liable for any loss of value of the\nresulting from handling them beyond what is necessary to\nverify their nature, characteristics and condition.<\/p>\n\n\n\n

The deadline for returns is 14 days from the date of receipt of the order. The product must be in perfect condition and the refund will only be made once the returned product has been received. No refunds will be given for postage on items sent to you. Fica reserves the right to refuse the return of the product and consequent refund if the product is not in perfect condition.<\/p>\n\n\n\n

Exchanges or returns are not accepted for \"made-to-order\" or \"customizable\" items, as well as perishable material or used equipment\/material (including exposed canvases).<\/p>\n\n\n\n

Both the cost of sending the returned product and the cost of sending the new product are borne by the customer.<\/p>\n\n\n\n

Fica is not responsible for refunding PayPal fees.<\/p>\n\n\n\n

13. Services<\/strong><\/p>\n\n\n\n

Any service provided by FICA requires full payment in advance.<\/p>\n\n\n\n

14. Newsletter<\/strong><\/p>\n\n\n\n

Fica cannot be held responsible for errors in sending the newsletter or for sending it directly to spam.
Fica has the right to remove from the subscriber list any e-mail account that reports hard\/soft bounces or any error that jeopardizes the proper functioning of future newsletter mailings.<\/p>\n\n\n\n

15. Responsibilities<\/strong><\/p>\n\n\n\n

All the products sold on the site are in\nPortuguese legislation.<\/p>\n\n\n\n

Fica cannot be held responsible for damage suffered by\nthird parties resulting from the use of any of our products. Fica cannot\nbe held liable for damage suffered by the Customer as a result of misuse of our products.\nmisuse of our products.<\/p>\n\n\n\n

All content on this site (illustrations, texts,\ntitles, brands, images, videos) are the exclusive property of Fica or its\npartners. Partial or total reproduction of the content through any\nprocedure and on any medium is subject to the prior and express authorization of Fica.\nauthorization from Fica. <\/p>\n\n\n\n

They are therefore protected by the Copyright Code\nand Related Rights. Fica reserves the right to make changes to these contents at any time.\nchanges to these contents, and is under no obligation to make any\nprior notice to users.<\/p>\n\n\n\n

17. Applicable legislation<\/strong><\/p>\n\n\n\n

The use of this site and the purchase of items through it\nare governed by Portuguese law.<\/p>\n\n\n\n

Any dispute arising out of or in connection with the use of this website or transactions carried out through it shall be subject to the exclusive jurisdiction of the courts of Portugal.<\/p>\n\n\n\n
